Terms and Conditions of use of the site

Accessing www.americalegal.law implies acceptance of these terms. Please read them before using the site or sending us information.

Clause One

Purpose and acceptance

These Terms and Conditions govern access to and use of the site www.americalegal.law and all of its subdomains and sections. Accessing the site, browsing it and using any of its features imply full and unreserved acceptance of these terms in the version published at the time of access. Anyone who does not agree with them should refrain from using the site.

Clause Two

Identity of the operator

The site is operated by AMERICA LEGAL®, the brand under which AMERICA LEGAL BUFETE, S.C. operates, with offices at Avenida Insurgentes Sur 1425, floor 7, Colonia Insurgentes Mixcoac, Alcaldía Benito Juárez, Mexico City, C.P. 03920, and contact address info@americalegal.law.

Clause Three

Nature of the content

The information published on this site is for information and educational purposes only. It does not constitute legal, tax, accounting or financial advice on any specific case, does not replace professional consultation and must not be used as a basis for taking or refraining from any decision. The legislation, judicial criteria and administrative practices referred to may have changed after the publication date of each item.

Clause Four

No professional relationship

Accessing the site, subscribing to publications, submitting forms, downloading materials and communicating by email do not create an attorney-client relationship or any professional obligation on the part of the Firm. That relationship arises solely through the Firm's express acceptance of the matter, following a conflicts check, and the execution of the corresponding engagement instrument.

Clause Five

Confidential information

Users are asked to refrain from sending confidential information, supporting documentation or sensitive personal data through the site's forms. Information sent before the professional relationship is established may not be covered by professional privilege, and the Firm assumes no liability for its transmission, without prejudice to the security measures it applies to all data it receives. Once the relationship is formalised, the Firm will indicate the secure institutional channel for exchanging documentation.

Clause Six

Absence of conflict of interest

Sending an enquiry through the site does not prevent the Firm from representing interests adverse to those of the sender, so long as the professional relationship has not been established and the corresponding conflicts check carried out.

Clause Seven

Intellectual and industrial property

The AMERICA LEGAL® brand, the URDATEN® mark, the logo, the distinctive signs, the texts, images, designs, navigation structures, interactive visualisations and developments contained in the site are the property of the Firm or of their legitimate owners, and are protected by applicable industrial property and copyright law. Consultation and partial reproduction for non-commercial purposes are permitted, provided the source is cited, the content is not altered and no endorsement or connection with the Firm is suggested. Any other use requires prior written authorisation.

Clause Eight

Permitted use and prohibited conduct

The user undertakes to use the site in accordance with the law, good faith and these terms. The following are expressly prohibited: extracting content in bulk or by automated means; using the site or its content to train artificial intelligence systems without prior written authorisation; reverse-engineering its developments; introducing malicious code; impersonation; and any conduct that compromises the availability, integrity or security of the site or of the information it contains.

Clause Nine

Links to third-party sites

The site may contain links to sites operated by third parties, including strategic allies and organisations the Firm works with. The Firm exercises no control over their content, policies or practices, and assumes no liability arising from accessing or using them. The existence of a link does not imply recommendation, endorsement or any agency relationship.

Clause Ten

Availability, security and continuity

The Firm seeks to keep the site continuously available, without guaranteeing it. It may suspend, interrupt or limit access for reasons of maintenance, security, updating or causes beyond its control, without prior notice and without liability. The Firm operates under information security controls, which does not constitute a guarantee against force majeure events or third-party attacks.

Clause Eleven

Personal data and cookies

The processing of personal data collected through the site is governed by the Privacy Notice, and the use of cookies and similar technologies by the Cookie Policy, documents that form an integral part of these terms. The exercise of rights of access, rectification, cancellation and objection is handled in accordance with the procedure published at Data Subject Rights.

Clause Twelve

Electronic communications

The user accepts that communications sent by the Firm through electronic means, including email and notices published on the site, satisfy any requirement of written form, without prejudice to the formalities the law requires for particular acts.

Clause Thirteen

Amendments

The Firm may amend these terms at any time. The version in force will be the one published at this web address, indicating the date it was last updated. Use of the site after an amendment is published implies acceptance of it.

Clause Fourteen

Governing law and jurisdiction

These terms are governed by the laws of the United Mexican States. For their interpretation and performance, the parties expressly submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that might correspond to them by reason of their present or future domicile.

Clause Fifteen

Contact

Any question, comment or complaint relating to these terms may be addressed to info@americalegal.law, or to the address stated in clause two.

Clause Sixteen

Verification of the D-U-N-S® registration

The D-U-N-S® number of the Firm is published on this site and may be checked directly against the profile linked on The Firm page. Where a vendor onboarding process or a due diligence procedure requires further confirmation, it must be requested in writing to info@americalegal.law.

The Firm replies within a maximum of forty-eight hours counted from receipt of the message, and sends only the information needed to evidence the D-U-N-S® registration. The corporate file is not delivered with that reply: producing it requires sufficient legal cause, an identified requesting party and a stated purpose, and it is decided case by case under the duty of confidentiality the Firm observes towards its clients and over its own information.
