Personal data we process
Identification data —name, corporate or business name, signature, image and official documents—; contact data —address, email and telephone numbers—; employment and professional data; tax data; asset and financial data where the service requires it; and all information relating to the matter entrusted to us. We do not ordinarily collect sensitive personal data. Where the nature of the matter makes it indispensable, your express written consent will be obtained beforehand and specifically.
Purposes of processing
Necessary: to identify you and verify your capacity; to provide the services entrusted to us; to build and retain the file; to invoice and manage collection; to comply with the Firm's legal obligations; to respond to requests from the authorities; and to screen against restricted-party lists where the service requires it. Optional: to send you newsletters and regulatory alerts; to invite you to events and academic activities; and to run satisfaction surveys. You may decline the optional purposes by writing to privacy@americalegal.law, without this affecting the provision of the service.
Basis for processing
Processing is carried out on the basis of your consent and, in the case of the professional services relationship, on the necessity of the processing to perform that legal relationship, as well as to comply with the Firm's legal obligations.
Transfers
The Firm does not sell your personal data. It may disclose it, only to the extent strictly necessary or where required by law, to competent authorities; to experts, notaries, brokers and correspondent lawyers involved in your matter; to counterparties where procedural action requires it; and to technology providers acting as processors, contractually bound to confidentiality. International transfers are made only to providers offering equivalent protection safeguards.
Professional privilege
Independently of this notice, the information you entrust to the Firm within a professional relationship is covered by professional privilege, which is binding on all personnel and survives the end of the relationship.
Security measures
The Firm operates an information security management system with profile-based access control, encryption, audit logging, periodic backup and staff training. It has an Information Security and Technology Committee, a Data Protection Officer and written internal policies on the use of technology, data and artificial intelligence.
Use of artificial intelligence
We use artificial intelligence tools expressly authorised by internal policy, solely to support process tasks. No deliverable is produced without review, correction and assumption of responsibility by a professional of the Firm. Unauthorised tools are not used and public models are not fed with identifiable client information.
Data subject rights and withdrawal
You may access your data, rectify it, cancel it and object to its processing, as well as withdraw consent and restrict its use or disclosure. Send your request to privacy@americalegal.law with your full name, a means of reply, official identification, and a clear description of the data and of the right you are exercising. We will reply within a maximum of twenty business days and, if the request is well founded, we will give effect to it within the following fifteen business days. The exercise of these rights may be limited where the data is necessary to comply with a legal obligation or to defend legitimate interests. See the procedure at Data Subject Rights.
Cookies
This site uses cookies and similar technologies under the terms of the Cookie Policy, to which express reference is made.
Retention
Data will be retained for the duration of the professional relationship and, once it ends, for the periods imposed by applicable tax, commercial and anti-money-laundering rules, as well as for as long as is necessary for the Firm's defence. Once those periods elapse, the data will be blocked and deleted.
Amendments
Any amendment will be published at this same web address, indicating the date it was last updated.
Authority
If you consider that your right to personal data protection has been infringed, you may apply to the Anti-Corruption and Good Governance Ministry, the competent authority in this field.
