Conditions of Use of Publications

Purpose and scope

This document governs the use, reproduction, citation and distribution of the publications of AMERICA LEGAL®, understood as Forum entries, ESG Observatory bulletins, sector matrices, regulatory analysis notes, presentations, infographics and any other informative material distributed through www.americalegal.law, both in its electronic version and in the downloadable PDF file, in Spanish or in English.

It complements clause seven of the Terms and Conditions of use of the site and develops it as regards publications. In the event of any discrepancy concerning the use of a publication, this document prevails.

Ownership of rights

The economic copyright in the publications belongs to AMERICA LEGAL BUFETE, S.C. Moral rights belong to their authors and are, under the Mexican Federal Copyright Law, inalienable, imprescriptible, non-waivable and not subject to attachment.

The names AMERICA LEGAL®, URDATEN® and ALIAD — Institute of Senior Management, as well as the emblem, the logotype and the other distinctive signs of the Firm, are protected under industrial property legislation. Their reproduction beyond the authorized citation requires prior written consent.

Nature of the content

The publications are informative and professional in purpose. They do not constitute legal, tax, accounting or financial advice on a specific case, they do not replace professional consultation, and reading them does not create an attorney-client relationship.

Each publication reflects the state of the legislation, of judicial criteria and of administrative practice as at the date it bears. The Firm assumes no obligation to update it. Whoever cites or relies on it must verify that it remains current as at the date of use.

Uses authorized without prior request

Provided the citation obligation in clause five is fully complied with and the content is not altered, the following are authorized without any request:

a) Consulting, reading and printing the publication.

b) Downloading one copy in PDF format for personal, internal or professional non-profit use.

c) Reproducing extracts in works of your own — briefs, opinions, articles, papers or internal training materials — up to four hundred words or twenty per cent of the text, whichever is less.

d) Linking directly to the electronic address of the publication, without framing or any presentation that attributes the content to a third party.

e) Citing it in judicial, administrative or academic filings, with the full reference.

f) Circulating the complete PDF file within a single organization, without any alteration and preserving the folio, the footer and the notices it contains.

Citation obligation

No authorized use takes effect without a full citation. Omitting the citation, giving a reference that does not allow the publication to be identified, and making a generic reference to the site or to the Firm are all treated as unauthorized use.

The citation must follow this format:

In digital media the citation must include an active link to the electronic address of the publication; in print, the address in plain text is sufficient. Where a publication bears no individual author, the citation begins with AMERICA LEGAL®. Every publication displays its own ready-made citation at the foot, which can be copied directly.

Prohibited uses

The following are prohibited save with the prior written authorization of the Firm:

a) Reproducing the publication in full in your own or third-party media, print or digital, including newsletters, portals, repositories and social networks.

b) Any commercial use, understood as the sale, resale or licensing of the publication, or its incorporation, in whole or in part, into paid products, services, courses or materials.

c) Producing derivative works — translation, summary, adaptation, recasting or reworking — and distributing them under different authorship.

d) Removing or altering the authorship, the folio, the trademarks, the footer or the legal notices of the document.

e) Bulk or automated extraction of content, including systematic crawling and text and data mining.

f) Using the publications to train, fine-tune, evaluate or feed artificial intelligence systems, including their incorporation into training sets, vector databases or retrieval-augmented schemes. This reservation is made expressly for all legal purposes.

g) Presenting the content in a way that suggests endorsement, co-authorship, review or any connection of the Firm with a third party, its products or its positions.

h) Decontextualized use that alters the meaning of the analysis or misleads as to its scope.

Use by the media

The media are authorized to reproduce extracts with a full citation and an active link, and to request interviews, statements or further detail. The institutional contact is digitalcm@americalegal.law and (+52) 55 6385 7030.

The extract must identify the publication and its author and must not alter the meaning of the analysis. The Firm may request the correction or withdrawal of erroneous attributions, and does not authorize the use of its publications in third-party advertising.

Academic and teaching use

Citation in theses, peer-reviewed articles, conference papers and non-profit teaching materials is authorized, with the full reference. Sending the published reference to digitalcm@americalegal.law is appreciated, though not required.

Full reproduction in anthologies, compilations or institutional repositories requires prior written authorization, which the Firm ordinarily grants at no cost for academic purposes.

PDF download and prior registration

The PDF file of each publication is a faithful copy of its electronic version and is delivered upon identification of the requester by name and email address. The processing of that data is governed by the Firm Privacy Notice and serves to evidence delivery, to answer queries about the publication and, where the data subject consents, to send subsequent publications.

The file preserves the folio, the footer and the legal notices. Hosting it in third-party repositories, having it indexed by search engines outside the site, or distributing it in bulk beyond the requester organization is not authorized.

Publication folio and verification

Each publication bears a folio structured as AL-FORO-YYYY-NNN, where YYYY is the year of publication and NNN the consecutive number of the entry. The folio identifies the piece and the version concerned.

The authenticity of a document presented as issued by the Firm may be checked on the Verification page of the site or requested in writing at info@americalegal.law. A document with no folio, with an altered folio, or whose content does not match what is published at this electronic address is not recognized as issued by AMERICA LEGAL®.

Amendment and withdrawal of publications

The Firm may correct, update, replace or withdraw any publication. Where the correction affects the meaning of the analysis, the date and scope of the amendment are recorded. The version in force is always the one published on the site.

Anyone holding or having reproduced an earlier version must refrain from presenting it as current once they become aware of the correction.

Requesting authorization

Authorizations are requested in writing at digitalcm@americalegal.law, stating the publication and its folio; the intended use; the medium, reach and period of distribution; and the identity of the requester. The Firm replies within ten business days.

Every authorization is specific to the use requested, non-exclusive, non-transferable and revocable. It entails no assignment of rights and no licence over uses other than those authorized.

Consequences of unauthorized use

Use of the publications in breach of this document entitles the Firm to demand the immediate withdrawal of the content, the publication of the correction or of the omitted attribution, and compensation for the damage caused.

The foregoing is without prejudice to the actions available under the Mexican Federal Copyright Law, the Federal Law for the Protection of Industrial Property, the Federal Civil Code and other applicable provisions, including those of a civil, administrative and criminal nature.

Reservation of rights

Every right not expressly authorized in this document is reserved to its holders. Neither its provisions nor the making available of the publications to the public constitutes an assignment, an implied licence or a waiver of rights.

Governing law and jurisdiction

This document is governed by the laws of the United Mexican States. For its interpretation and performance, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other venue that may correspond to them by reason of their present or future domicile.

The Firm may amend this document at any time. The version in force is the one published at this electronic address, with its date of last update. Use of the publications after an amendment is published implies acceptance of it.
